New Interpleader Funds Procedures Effective April 1, 2017

The Administrative Office of the United States Courts developed a central investment option, Disputed Ownership Fund (DOF), in the Court Registry Investment System (CRIS) to facilitate courts’ compliance with tax reporting requirements for interpleader funds deposited under 28 U.S.C. § 1335.
Pursuant to S.D. Ala. CivLR 67 and Standing Order #35, all funds shall be tendered to the court for deposit into, and disbursement from, CRIS only by court order, and movants shall provide to the clerk a copy of the order authorizing deposit or disbursement. Accordingly, two new electronic case filing events were created to support procedures for deposit and disbursement of interpleader funds:

  • Motion for Interpleader Deposit (28 U.S.C. Section 1335), and
  • Motion for Interpleader Disbursement (28 U.S.C. Section 1335).

A proposed order specifying the amount of money and identifying the funds as interpleader funds under 28 U.S.C. § 1335 will be filed as an attachment to these two motions. Proposed orders to disburse funds shall also include the payee's full name and complete address.
Please note that funds deposited into and disbursed from the court’s registry which are not defined as interpleader funds under 28 U.S.C. § 1335 will continue to be filed using events:

  • Motion to Deposit Funds, and
  • Motion for Release of Funds.
